    When Roofing Goes Wrong: Property Damage and Liability

    Roofing is inherently messy and sometimes damaging — heavy materials, tools at height, and debris falling from above. Most damage is minor and easily resolved. But you need to know your rights.

    Common Types of Property Damage

    • Landscaping damage — crushed shrubs, flattened flower beds, torn-up grass from heavy equipment and debris
    • Gutter damage — dented or detached gutters from ladder placement
    • Siding and paint damage — scrapes and dents from falling debris or ladders
    • Window damage — cracked or broken from dropped tools or materials
    • Interior damage — ceiling cracks from vibration, water intrusion from improper tarping
    • Driveway damage — stains from dumpsters, cracks from heavy equipment

    Who's Liable?

    If the damage was caused by the contractor or their crew during the project, the contractor is liable — not you. This is exactly what general liability insurance covers.

    If the contractor is properly insured:

    1. Document the damage with photos
    2. Notify the project manager immediately
    3. The contractor files a claim against their liability policy
    4. The insurance company pays for repairs or replacement
    5. You shouldn't pay anything for damage you didn't cause

    If the contractor is NOT insured:

    You have a serious problem. You'll need to:

    1. Document everything
    2. Send a written demand for repair
    3. If they refuse, you may need to file a claim on your own homeowner's insurance or pursue legal action
    4. This is why verifying insurance before work begins is absolutely critical

    How to Protect Yourself

    Before the project:

    • Verify the contractor's general liability and workers' comp insurance
    • Take "before" photos of your property — landscaping, siding, driveway, windows
    • Discuss damage prevention measures with the project manager

    During the project:

    • Walk the property daily and note any new damage
    • Communicate immediately with the project manager if you see issues
    • Don't wait until the project is complete to raise concerns

    After the project:

    • Do a thorough walk-around before making final payment
    • Document any damage with photos and discuss resolution
    • Get repair commitments in writing with a timeline
